This website is owned and operated by jwcraftstudio.co.uk

 

The purpose of the site is to provide you with information about the business of JWCraftStudio, our products and services, and the activities we undertake. Throughout the site, the terms “we”, “us” and “our” refer to JW Craft Studio. JW Craft Studio offers this website, including all information, tools, products and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.  If you have any questions about these terms and conditions or if you have any comments or complaints about our service or website, you can contact us at: jwcraftstudio@gmail.com 


In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

By visiting our site and/or purchasing something from us, you engage in our “Service” you approve that you have read, understood, and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink or on our website. 

 

Our store is hosted on Wix.Com. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

 

 

2. Ownership of intellectual property, copyrights and logos

All rights, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, in this website are the exclusive property of JW Craft Studio. 

 

Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose. If you would like to request to use any of the images on our website please contact jwcraftstudio@gmail.com

3. Prohibited Uses and Right to Suspend or Terminate

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You may not post anything illegal, or which could be considered defamatory or abusive.

You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

 

 

4. Accuracy of Content

Despite our very best efforts to ensure product information and prices quoted are current and correct, and that all products have been fairly described, we cannot guarantee the absence of errors. Any weights, dimensions and specifications given about the goods are approximate only and are used within our shipping parameters to calculate shipping costs. The images of the Products on our Website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your phone or computer's display of the colours accurately reflect the colour of the Products. Please note that the piece of wood you are buying is unique, the grain and knots are entirely natural and are not seen as defects. Like all natural materials, wood has inherent disparities in colour and grain pattern because of variations caused by nature, as a result individual products will have subtle variations from one piece to the next, caused by variations in the wood as well as the hand-crafting. The images, descriptions, and measurements you will find on our site have been used to best portray the products we sell, the grain and colour of the wood in each product may vary slightly from the pictures shown.  We do not give any warranty as to the accuracy or completeness of the information and cannot be responsible for any errors or omissions or for the results arising from the use of such information. Description and product information on our website are solely to provide an idea of the goods they describe and do not form part of the contract between you and us and are not intended to be binding.

 

If there is a clear error or omission in the product description, we will notify you prior to dispatch of your order and refund you in full if you wish to cancel your order once the information has been corrected and applied to your order.

 

 

5. Retention of Right to Change Offering of Products or Services  

All products and services are subject to availability and we reserve the right to withdraw or discontinue products or services that we offer, or remove / edit content on our website at anytime without prior notice, at the sole discretion of us. All descriptions of products, services or pricing are subject to change at anytime without prior notice and liability for any reason, or for no reason.

 

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

 

6. The Contract between the customer & JW Craft Studio 

By placing an order with us, you agree that: (i) that you are over 18 years old and are legally capable of entering into binding contracts, (ii) you are responsible for reading the full item listing before making a commitment to buy it: (iii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. 

 

We must receive full payment for the goods that you order before your order can be accepted and shipped.  

 

We will confirm that your order has been accepted by sending an email to you at the email address you provide on your website order.  Our acceptance of your order brings into existence a legally binding contract between us.  On occasion, order confirmation emails are redirected to spam by mail servers.  In the first instance please check your junk email folder if you have not received confirmation of your order.

7. Making a Purchase and Availability

If you would like to place an order you may do so via the website by clicking on individual shop product and ‘add to your basket’ and then proceed to ‘check out’ to make payment and complete your details needed to complete your order.   You will need to provide us with your e-mail address and mobile number.

7a. Acknowledgement and Processing of your order

Any order that you place with us is subject to product availability and acceptance by us.  Once you have clicked on the ‘Submit Order’ button, you have made a binding offer for the sale of goods. Your offer at this stage is still subject to our acceptance. When you place your order online an email confirmation will be produced automatically so that you have confirmation of your order details.  The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your order.  

 

We reserve the right to alter the goods available and/or withdraw or discontinue any product or service.  We may refuse or be unable to process your order if:

  • The product or service you ordered is discontinued or no longer available.

  • Your credit card does not give authorisation for the payment of the purchase price

  • You do not meet the eligibility to order criteria set out above.

If your order has not been accepted, you will be notified via email together with the reason.

We will not be liable to you for any loss or damage directly or indirectly resulting from such refusal or inability to process your order.

For personalised items it is your responsibility to check accuracy before purchase.

 

For bespoke orders/commissions please contact us via our website or email us to discuss. Lead times for items will vary depending on the order and can be between 1 and 12 weeks.  This can sometimes be longer during busy periods, but this will be made clear before ordering your item(s).  We always aim to create your item(s) as fast as possible and in some cases can exceed expectations.

7b. Promotions

Only one promotional offer can be used at any one time and any Promotion Codes are not valid during Sale Periods or on items in our Sale Room. 

All promotional codes remain the property of JW Craft Studio and we reserve the right to stop or remove a promotion at any time without prior notice. 

 

 

8. Mistakes when Ordering

If you make an error when ordering don’t hesitate to contact us to make changes before your order is shipped. Once the order has been shipped we will be unable to make changes.

  

 

9. Prices and Payment Terms

All prices listed on our website are in £s sterling/GBP and inclusive of Valued Added Tax.  All prices are deemed to be correct at the time of publication; however, we reserve the right to alter these in the future. 

 

Where stated, prices include delivery. The cost of delivery is to mainland England, Wales, Scotland, Channel Islands and the Isle of Man.  Please contact us for delivery charges to all other areas.

9a. Bespoke and Commissions

Prices for delivery for Bespoke items and Commissions will vary depending on order size and weight. We work hard to try and get the best delivery prices for you; we aim to provide well packaged and protected products for them to arrive undamaged and in sound condition.

 

You agree that the credit or debit card details that you provide is your own credit or debit card and that you have sufficient funds to make the payment.

 

Payments will be taken at the time of purchase and is processed via PayPal through our online e-commerce platform. All card information is encrypted using an industry standard SSL/TLS encrypted connection technology and passed to PayPal for authorization. No credit card information is stored on the JW Craft Studio.co.uk server at any time.

 

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

10. Delivery 

We currently use a variety of couriers depending on the product ordered; generally, deliveries are shipped using a 2 day plus delivery service (please be aware this does not include the weekend so any placed on a Friday will not be processed until the following Monday), estimated arrival are normally within 2-5 business days from shipping.  For larger or commission products a longer shipping time may be required. 

 

We currently only accept orders to the UK.  If you live outside of the UK please contact us for a price for postage.  This will be invoiced separately to you as an extra charge.  

We do not offer click and collect services.

Goods will be delivered to the address you specify for delivery in your order. Please ensure the address and postcode is correct at the time of ordering. 

 

We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). 

 

We will aim for delivery of goods within the normally delivery times, but delivery times are not guaranteed and dependent on our courier service; we will not be liable for any loss caused to you by late delivery. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you.

 

Before placing an order, please measure carefully to ensure that your item(s) will fit into the room it’s intended for and that it will also fit through any passages, access gates, stairwells, landings and internal doors. We cannot be held accountable for furniture that doesn’t fit. Should it not fit and has to be returned to us we will charge return costs to the value we paid for your delivery. 

 

If you fail to accept delivery of the goods at the time they are ready for delivery, or we are unable to deliver the goods at the nominated time due to your failure to provide appropriate instructions, then the goods shall be deemed to have been delivered to you and all risk and responsibility in relation to such goods shall pass to you.  Any storage, insurance and other costs which we incur as a result of the inability to deliver goods shall be your responsibility and you shall indemnify us in full for such cost.

 

Where delivery is outside the UK, you may be liable to pay additional tax or duty once the goods reach your country.  This may vary from country to country.  Please contact your local customs office for more information.

 

Please note that goods may be subject to inspection by your local customs office where delivery is outside the UK.

 

 

11. Risk and Ownership

You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to accept delivery of the goods at the time they are ready for delivery, or we are unable to deliver the goods at the nominated time due to your failure to provide appropriate instructions, then the goods shall be deemed to have been delivered to you and all risk and responsibility in relation to such goods shall pass to you. 

Goods supplied are not for resale.

 

 

12. Cancellation Rights and Return and Refund Policy

We hope that you will be delighted with your order, however there may be an occasion where you need an exchange or a refund.  If for any reason you are unhappy with your purchase, please contact us within 3 days of delivery and we will do all we can to rectify the situation.  

 

All items should be returned within 14 days in a resalable condition. Where possible, we would ask that you return the item(s) with the original packaging. 

With the exception of faulty items, we are not responsible for return postage.

 

If you are a UK consumer, you have the legal right, under the Consumer Contract Regulations 2013 to:

12a. Your right to cancel

  • You have the right to cancel this an order for goods the moment you place your order and ends 14 days from the day you receive your goods. 

  • If your order consists of multiple goods, the 14 day period runs from when you get the last of the batch.

  • This 14 day period is the time you have to decide whether to cancel, you then have a further 14 days to actually send the goods back.

 

Important: if you choose to cancel your delivery after it has dispatched, you may have to pay an additional fee to cover the cost of returning it to us.

12b. Your right to a refund

  • You should get a refund within 14 days of either of when we receive the goods back, or you providing evidence of having returned the goods (for example, a proof of postage receipt from the post office), whichever is the sooner. 

  • A deduction can be made if the value of the goods has been reduced as a result of you handling the goods more than was necessary.

  • The extent to which you can handle the goods is the same as it would be if you were assessing them in a shop.

12c. Refunding the cost of delivery

We will refund the basic delivery cost of getting the goods to you in the first place, so if you opted for enhanced service e.g. guaranteed next day, we will only refund the basic cost.

 

Unfortunately, we cannot cover the returns cost.  

We cannot accept liability for any goods lost or damaged in transit.

 

Exemptions - personalised goods or bespoke goods

The right to cancel as described in 12a above does not apply to orders for personalised goods or bespoke goods which are made or altered to your specifications.

 

If you decide you need to cancel an order for personalised goods or bespoke goods which are made to your specifications, then please contact us immediately.  It may be possible to cancel your order and refund a part of the amount paid by you if work has not commenced on the item.  This will be considered on a case by case basis.

 

We will be unable to process your return if unwanted items are returned to us damaged.

Returns where Goods are Faulty:

If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the delivery documentation and inform us (by phone or e-mail only) upon receipt of delivery. 

 

You must return the products to us as soon as possible (within fourteen days of receipt of your order) after informing us that the products are damaged or have been incorrectly supplied.

 

We will offer you the option of a full refund, repair or replacement.  On receipt of your returns, we will process your refund within 5-7 working days. If a repair or replacement is required, this may take longer.

 

Please note that we will not accept the return of any damaged or incorrectly supplied products where you fail to notify us of this within 14 days of receiving them. 

 

 

13. Cancellation of your Order by Us 

We reserve the right to cancel the contract between us if:

  • we have insufficient stock to deliver the goods you have ordered;

  • one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

 

If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. 

 

 

14. Promotional emails and content 

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. 

 

 

15. Third-Party Links 

In an attempt to provide increased value to our visitors, JWCraftStudio may link to sites operated by third parties that are not affiliated with us; these linked sites are only provided for your convenience and which may be of interest to you and therefore you access them at your own risk. However, even if the third party is affiliated with JWCraftStudio.co.uk or JW Craft Studio; we do not represent the quality of the goods or services provided by such third parties nor do we have any control over the content or availability of such sites. 

 

We cannot accept any responsibility for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

 

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. 

 

Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

This site and the materials and products on this site are provided “as is” and without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, JW Craft Studio disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. JW Craft Studio does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. JW Craft Studio does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

18. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall JWCraftStudio be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, JWCraftsStudio assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the relevant goods.  We exclude liability for losses that were not foreseeable to both parties when the contract was formed and losses that were not caused by any breach on our part.  This limitation of liability does not apply to personal injury or death arising as a direct result of our negligence.

 

We do not accept any liability for any delays, failures, errors or omissions or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your computer system via our website except where this has been caused by our negligence.

 

We shall not be held liable for any failure or delay in delivering goods where such failure arises as a result of any act or omission which is outside our reasonable control such as an act of God or those of third parties.

 

We have taken all reasonable steps to prevent internet fraud and ensure any data collected from you is stored as securely and safely as possible.  However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties except where this has been caused by our negligence.

 

 

19. Applicable Law 

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the English Courts.

 

 

20. Rights to Change and Modify Terms

We reserve the right to amend these Terms without notice to you from time to time at our sole discretion. Any such amendment shall be effective once the revised terms have been posted on the site.  It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.  If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
